By accessing or using loser.gg (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. Your continued use constitutes acceptance of any future modifications or updates to these Terms.

Changes to Terms

loser.gg may update these Terms at any time. Changes take effect when posted to the Service or otherwise communicated to you. By continuing to access or use the Service after a change takes effect, you accept the updated Terms. Review these Terms periodically to stay informed.

• Impersonate any person, entity, brand, or representative of loser.gg, or falsely suggest affiliation, endorsement, or sponsorship.
• Access or attempt to access another user's account, private data, or non-public areas of the Service without authorization.
• Deploy, authorize, or benefit from automated scripts, bots, crawlers, or similar tools that interact with the Service without prior written permission.
• Upload, distribute, or host malicious code, viruses, exploits, or other harmful content intended to disrupt, harm, or compromise data or systems.

We reserve the right to suspend, restrict, remove, or terminate any account, page, or content at our discretion. Enforcement actions may occur with or without prior notice.

Prohibited Content and Activities

The following content and behaviors are strictly prohibited on loser.gg. Any content or conduct that threatens user safety, legal compliance, or platform integrity may result in immediate account action, up to and including permanent termination and reporting to authorities.

• NSFW, sexually explicit, or pornographic material of any kind, including any content that sexualizes minors or depicts non-consensual imagery.
• Hate speech, discrimination, or content that targets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
• Graphic violence, gore, or content that glorifies or encourages self-harm, violence against others, or terrorism.
• Spam, phishing, deceptive practices, impersonation, or attempts to collect user information without consent.
• Piracy, copyright infringement, or distribution of content you do not have the rights to share.
• Cheating tools, game exploits, hacks, or software designed to gain unfair advantages in online games or circumvent platform security.
• Any content or activity that violates United States federal or state law, or applicable international law.

We take violations involving illegal content especially seriously. Where legally required or appropriate, we will report such activity to law enforcement and cooperate fully with lawful investigations.

File and Media Uploads

loser.gg allows you to upload images and videos for use on your profile page, or as hosted file download URLs made available through the Service. This feature is intended for personal, social, and profile use. It is not a general-purpose CDN, content delivery network, or backend for applications, bots, or automated systems.

Do not use uploads to distribute illegal content, infringing material, malware, or any prohibited content. We may throttle, remove, or restrict files that violate these Terms or impose disproportionate load on our infrastructure. Misuse may result in limits, suspension, or termination of your account.

You are responsible for ensuring you own or have the necessary rights to upload and share any file or media through the Service.

Inactive Username Policy

Free plan users who have not made any edits or changes to their page, or whose page contains no content, for a period of three (3) months or more may have their username made eligible for claim by other users. loser.gg reserves the right to release and reassign inactive usernames without prior notice to the original account holder.

A username may be considered inactive if the associated page has gone unedited, has had no content added, or shows no meaningful activity within the applicable period. Upgraded or paid accounts are not subject to this policy for as long as an active purchase is associated with their account.

Account Limitations

Each individual may create and maintain only one account. Attempts to create multiple accounts for the same individual may result in removal or consolidation of additional accounts without notice. Accounts are for personal use only. Do not share your credentials or sell access to your account.

If we detect suspicious patterns such as coordinated abuse, evasion of prior enforcement, or reseller behavior, we may take action on all related accounts and associated payment methods.

User-Posted Content and Licensing

You are solely responsible for the legality, reliability, and appropriateness of any content you post, upload, or link to through the Service. You represent and warrant that you own or have obtained all rights necessary to post the content, and that your content does not violate law or third-party rights.

You grant loser.gg a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to host, store, reproduce, modify, adapt, publish, distribute, and publicly display your content as reasonably necessary to operate, maintain, and improve the Service.

You retain ownership of your content. This license ends when you delete the content from the Service, except where we retain copies as required for legal, regulatory, security, or audit purposes.

Purchases

loser.gg offers one-time purchases for premium features, cosmetics, and other offerings. All prices are shown before applicable taxes and fees, which are calculated at checkout. We may change prices at any time; changes do not affect charges that have already been paid except in the case of a billing error.

You agree to provide current, complete, and accurate payment and account information for all purchases. You authorize us to charge your chosen payment method for the amounts due when you place your order.

We may refuse or limit any order at our discretion, including orders that appear to be placed for resale or distribution.

No Refund Policy

All payments made to loser.gg are final and non-refundable, except where a refund is required by applicable law. We do not provide refunds for change of mind, unused features, or partial use.

If a payment was processed incorrectly due to an error on our part, we may, at our sole discretion, issue a refund or account credit. To request a review, contact [email protected] with relevant details.

Initiating a chargeback or payment dispute for a valid and properly processed charge is considered a violation of these Terms. In such cases, we reserve the right to suspend, restrict, or permanently terminate your account and revoke access to any purchased features until the dispute is resolved.

Security

We take reasonable organizational and technical measures to help protect the Service and user data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

You are responsible for safeguarding your account credentials. Notify us promptly at [email protected] if you detect or suspect unauthorized access or unusual activity in your account.

Third-Party Services and Links

The Service may display or link to third-party websites, services, or content. We do not control, endorse, or assume any responsibility for third-party content, policies, or practices. Use of third-party resources is at your sole risk.

Users may include third-party links in their profiles, provided doing so is lawful and does not imply association, approval, or endorsement by loser.gg where none exists. We may remove links or content we deem inappropriate, unlawful, or in violation of these Terms.

Intellectual Property

The Service and all materials on it (excluding your content) are protected by copyright and other intellectual property laws. Except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works of any part of the Service without our prior written permission.

All rights not expressly granted are reserved by loser.gg and its licensors.

Limitation of Liability

To the maximum extent permitted by applicable law, loser.gg and its affiliates, officers, employees, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages.

In no event will loser.gg's total liability for all claims arising out of or relating to these Terms or the Service exceed the greater of: (a) the amount you paid to loser.gg, if any, during the twelve (12) months prior to the event giving rise to the claim; or (b) one hundred US dollars ($100).

Indemnity

You agree to indemnify, defend, and hold harmless loser.gg, its owners, affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or relating to your content, your use or misuse of the Service, your violation of these Terms, or your infringement of any rights of another person or entity.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind. To the fullest extent permitted by law, loser.gg disclaims all express, implied, and statutory warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. You use the Service at your own risk.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in New York.

Law Enforcement Requests

loser.gg complies with valid legal process as required by applicable law. Law enforcement agencies or rights holders seeking information or action should submit requests in writing to [email protected].

Term and Termination

These Terms remain in effect from the time you first access the Service until terminated by either party. You may stop using the Service at any time. We may suspend, restrict, or terminate your account or access for any reason permitted by these Terms, including violations, misuse, fraud, non-payment, or compliance with applicable law.

Upon termination, all rights granted to you under these Terms will immediately cease. Sections that by their nature should survive termination, including ownership provisions, payment obligations, disclaimers, indemnities, and limitations of liability, will remain in effect.

Privacy

Your use of the Service is subject to our Privacy Policy, which explains what we collect, how we use it, and your choices. By using the Service, you consent to our data practices as described there.
